LTC Lakin waived his Article 32 hearing on 4 June 2010.  Once the Article 32 was waived, the charges were forwarded by Walter Reed commanding general with a recommendation as to disposition to MG Horst, the Military District of Washington Commander, on 8 June 2010. It is now up to MG Horst, to determine if the case will go to court-martial and the level of court-martial. MG Horst could also decide that some other disposition is more appropriate than court-martial.  MG Horst is the General Court-Martial Convening Authority for Soldiers assigned to Walter Reed Army Medical Center.

    The video is finally posted.

    In it LTC Lakin does not address his charges but simply states he is pursuing the CM to make a point about the validity of the President. It appears that he continues to have reservations and, in spite of bein a graduate of AMEDD basic and advanced officer’s schools, is not adhering to the de facto officer principle which is taught in both schools. This is, as far as I can tell, a violation of his officer’s oath, especially the part about not having reservations or not being evasive.

    I believe that one of the defenses that have been put forth in his behalf by others has been the officer’s oath. I wish that those who continue to use this line of thought would actually read the oath in its entirety.

    Here it is, so you don’t have to google it:

    I (insert name), having been appointed a (insert rank) in the U.S. Army under the conditions indicated in this document, do accept such appointment and do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic, that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter, so help me God.

    Don’t have to Google the oath, have taken it many times.

    I’m intrigued about the teaching part. Do you or anyone have access to the training materials at the various school’s. That would be a significant point to be able to show that LTC Lakin took a class which specifically addressed issues he’s not complaining about.
